US Court Orders Freedom of Abrego Garcia from ICE Detention

A federal judge has ruled the prompt discharge of Kilmar Abrego Garcia from immigration custody, concluding his ongoing confinement lacks lawful basis.

"Since Abrego Garcia's release after wrongful detention in El Salvador, he has been re-detained, again without lawful authority," Judge Paula Xinis wrote in her order.

The case originates in a erroneous deportation to El Salvador in March, which the government later admitted was an error. After his repatriation to the United States to answer alien smuggling charges, he was detained in federal detention.

In her order, the court pointed out that the government does not have a valid removal order, which prevents them from removing Mr. Abrego Garcia "at this juncture."

Context of the Legal Challenge

The legal challenge involve conflicting assertions. Whereas the former administration argues that Abrego Garcia is a member of the MS-13 gang, he categorically denies this claim.

He has also pleaded not guilty to the conspiracy charges, which are part of a separate trial in Tennessee.
