The NBA legend Tells Court He Felt No Fear of the Racing Body in Legal Battle
The basketball icon, as he cordially introduced himself in a Charlotte court on Friday, admitted that his drive to win and novelty within the sport emboldened his effort with 23XI Racing to confront Nascar over perceived violations of competition laws.
Team Investment and a Will to Win
Jordan shared operational insights of his 23XI team, revealing he put in $40m of his personal wealth into the Nascar Cup series team co-founded with business partner Curtis Polk and driver Hamlin.
“Someone had to step forward,” Jordan stated in the Charlotte courtroom. “I was a new person, I wasn’t afraid. I felt I could challenge Nascar in its entirety. I felt as far as the sport required examination through a new lens.”
The Core Dispute: Charter Agreements and Renewal Demands
At issue is the end of a 2016 deal where Nascar provided each team a franchise. This system mirrors other major leagues with separately owned franchises, such as the Charlotte Hornets or the NFL’s Panthers. This deal was due to end in 2024 when Nascar insisted on teams renew their charters.
Jordan testified for an hour and left the court to pandemonium, with onlookers and reporters vying for a glimpse or a photo of the global icon.
Spearheading the Fight
23XI Racing is at the forefront of the push along with another racing team for Nascar to overhaul a operating model Jordan said is breaking the law to keep two hands on the wheel.

“Denny convinced me getting a third driver boosted our odds of winning,” he testified, sharing that he bought a third charter late in 2024 for $28 million despite the uncertainty. “So I dove in.”
Heather Gibbs’ Testimony
Gibbs described her push for indefinite franchises, which she said a written letter to Nascar. She testified the timing of the contract signing demand didn’t sit well.
She said, Joe Gibbs first attempted to call and persuade Nascar against demanding signatures, but Nascar’s leader declined the request.
“Don’t do this to us,” Heather Gibbs said was the message to Nascar’s executives. The response was, “If I wake up and I have 20 charters, that’s what I have. If there are 30, I have 30.”
